In no event shall Us, Broker, or any of their Associates or any affiliated companies be liable to any party for any damages including without limitation, any direct, indirect, special, punitive, incidental or consequential damages (including, but not limited to, damages for loss of business profits, business interruption, loss of programs or information, or loss of savings), or any other damages arising - in any way, shape or form - out of the availability, use, or reliance on, the information provided herein even if Us, Broker, or any of their Associates, shall have been advised of the possibility of such damages, and regardless of the form of action, whether in contract, tort, or otherwise.

You expressly agree to indemnify and hold Us, Broker, and all of their Associates harmless from any claim or demand, including reasonable attorneys' and experts' fees, made by any third party due to or arising out of your use of the information, including but not limited to any further dissemination of the information.

In the event that you choose to review the White Paper available from Us, and then after choose to review the available inventory from Us, you agree to not purchase or offer to purchase any of the properties listed on such available inventory list made available to you or any other properties from the same source or market as where or in Ushas obtained the properties (collectively, the "Properties") from any person or entity other than Us. In the case where you are an agent for another individual or entity, you agree to not represent or otherwise assist any buyer in any way, including but not limited to distribution of your personal passcode, in any transaction related to the Properties or market wherein such buyer purchases or offers to purchase any of the Properties from any person or entity other than Us. In the event that you or any buyer represented by you as agent purchases any of the Properties or any property in the same market from a source other than Us, Us(and Broker, if applicable) shall be entitled to monetary damages, including but not limited to lost profits and/or commissions, from you, and in the case of your agency with a buyer, from such buyer.

You are reminded and agree that all real estate used for income or other investment purposes face the risks attendant to such an application, including that real estate values may go down, rents may decrease, and that vacancy rates may rise. Real estate is by its nature illiquid and a ready market may not exist for any particular property once purchased. Past performance is not a guarantee of future performance or results.
